What is Negligence?
Under Texas law, if someone is negligent and you get hurt because of it, they’re liable. To win a negligence case, you have to show that:
- The other party had a “duty of care” they didn’t live up to
- You got hurt because they didn’t live up to their responsibility
- You have damages from the accident
